Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website at landrycmd.com and the products operated by landrycmd (EIN 41-4998290) and its operator Brady Landry (collectively, "we," "us," or "landrycmd"). By using the services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use our products. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or present a security or abuse risk.
3. Acceptable use
You agree not to:
- Use the services for any unlawful purpose or in a way that violates any applicable law or regulation
- Infringe intellectual property, privacy, publicity, or other rights of others
- Attempt to gain unauthorized access to systems, accounts, or data not belonging to you
- Interfere with, disrupt, or overload the services or related infrastructure
- Send unsolicited commercial messages, spam, or content that is harmful, harassing, or obscene
- Reverse engineer, decompile, or otherwise attempt to derive source code from our products, except to the extent this restriction is prohibited by law
4. User content
You retain ownership of content you create or submit through the services ("User Content"). You grant us a non-exclusive, royalty-free, worldwide license to host, display, process, and transmit your User Content solely to operate and improve the services. You are responsible for your User Content and represent that you have all rights necessary to submit it.
5. Messaging and notifications
Certain products send transactional messages (SMS, email, push) to you. Message frequency varies. Standard message and data rates may apply. You can opt out at any time per the mechanisms described in our Privacy Policy. See that policy for additional details.
6. Paid services and refunds
Some products may offer paid plans. Pricing, billing cycles, and refund terms are presented at the point of purchase for the applicable product. You are responsible for all charges incurred under your account. We may change pricing with reasonable advance notice for existing subscriptions.
7. Beta, preview, and free tiers
We may offer beta, preview, or free tiers of our products. These features are provided "as is" and may be changed, suspended, or terminated at our discretion. Availability, uptime, and support for free tiers may be reduced compared to paid plans.
8. Disclaimer of warranties
The services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or meet your requirements.

9. Limitation of liability
To the maximum extent permitted by law, landrycmd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the services; (b) any conduct or content of any third party on the services; (c) unauthorized access to, use of, or alteration of your transmissions or content; or (d) any other matter relating to the services. Our aggregate liability shall not exceed one hundred U.S. dollars ($100) or the amounts paid by you to us in the twelve months prior to the claim, whichever is greater.
10. Indemnification
You agree to defend, indemnify, and hold harmless landrycmd from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the services, your User Content, or your violation of these Terms.
11. Termination
You may stop using the services at any time. We may suspend or terminate your access at our discretion for violation of these Terms, for security or abuse reasons, or if we discontinue the applicable product. Sections that by their nature should survive termination will survive.
12. Changes to the Terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the services after changes constitutes acceptance of the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the services shall be brought in a court of competent jurisdiction in Louisiana, and you consent to the jurisdiction of such courts.
